This Service Agreement & Liability Waiver (“Agreement”) applies to all services booked through the TrashStache platform. By booking a service, you (“Client”) agree to the following terms.
1. Independent Contractors
All service providers (“Vendors”) listed on TrashStache are independent contractors, not employees or agents of TrashStache. TrashStache acts only as a marketplace platform connecting Clients and Vendors.
2. Scope of Services
The specific services to be performed are described in the Client’s booking. Vendors are responsible for completing services in a professional and lawful manner.
3. Liability Waiver
By booking a service through TrashStache, Clients acknowledge and agree that:
- TrashStache is not liable for the quality, safety, or legality of services performed by Vendors.
- TrashStache is not responsible for property damage, personal injury, or losses arising from services, except in cases of gross negligence or willful misconduct.
- Clients assume all risks associated with hiring independent Vendors through TrashStache.
4. Client Responsibilities
Clients must:
- Provide safe and reasonable access to the property.
- Remove or secure fragile or valuable items before services begin.
- Disclose any known hazards to Vendors.
5. Insurance & Risk
Some Vendors may carry liability insurance; others may not. Hiring uninsured Vendors is at the Client’s own risk.
6. Dispute Resolution
Disputes must first be addressed directly between the Client and Vendor. TrashStache may, at its discretion, mediate but is not obligated to resolve disputes or issue refunds.
7. Governing Law
This Agreement is governed by the laws of [Insert State/Country], without regard to conflict-of-law principles.
8. Acknowledgment
By using TrashStache, Clients confirm that they have read, understood, and agreed to this Service Agreement & Liability Waiver.
By booking this service, I agree to the TrashStache Terms & Conditions, Privacy Policy, and Service Agreement & Liability Waiver. I understand that TrashStache is a marketplace platform and not the service provider, and that services are performed by independent vendors.
I release TrashStache from liability for property damage, injury, or loss, except in cases of gross negligence. I accept responsibility for providing safe access to my property and agree to resolve disputes directly with the vendor, with TrashStache acting only as a payment facilitator.
